1) Who we are

These Terms govern your use of our website and the purchase of our courses, events, and resources. By using the site or making a booking you agree to these Terms.

2) Key definitions

  • “We/us/our”: JC Holistics Ltd t/a Lymphaeum Education.

  • “You/your”: the site visitor, learner, or purchaser.

  • “Course”: any training, workshop, event, or digital resource we provide.

  • “Business Customer”: purchases wholly for business purposes.

  • “Consumer”: individuals acting outside their business (UK law).

3) Website terms of use (Wix)

3.1 Access & availability – We aim for 24/7 availability but do not guarantee uninterrupted service (hosting is via Wix). We may suspend or change the site without notice for maintenance or updates.
3.2 Content – Information is for general education only and is not medical advice. Always follow your professional scope of practice and local regulations.
3.3 Accounts – If the site allows log-ins (e.g., Wix Members Area), keep credentials confidential; you’re responsible for activity on your account.
3.4 Acceptable use – Do not misuse the site (unlawful, harmful, infringing, or disruptive activity).
3.5 Third-party tools – Our site may use Wix apps or third-party services (e.g., payments). Their terms apply in addition to ours.
3.6 Intellectual property – The site, logo, brand, text, images, videos, and course materials are owned by us (or licensed to us). You must not copy, share, record, or resell our materials without written permission. We grant a personal, non-transferable licence to enrolled learners to use course materials for study only.

4) Booking & payment

4.1 Eligibility – Unless stated otherwise, our CPD is for qualified practitioners (e.g., Level 3+). You’re responsible for holding the right qualifications/insurance.
4.2 How to book – Bookings are taken online (Wix) or by invoice. A contract is formed when we email confirmation.
4.3 Prices – Prices are shown in GBP and include VAT where applicable. We may change prices at any time before you book.
4.4 Payment – Payment is due at booking unless we agree an invoice/payment plan in writing. Places are confirmed only on receipt of cleared funds.
4.5 Invoices / employers – Where an employer pays, you remain responsible if the employer fails to pay.

5) Cancellations, rescheduling & cooling-off

Your legal cooling-off rights (consumers): For distance contracts, consumers generally have 14 days from contract to cancel services. If you ask us to start the service within that period, we may charge for work done; if the service is fully delivered within the period, the right to cancel may be lost. Some date-specific “leisure” services are exempt from cooling-off. Our courses are scheduled for specific dates and may fall within that exemption. We still offer the policy below. 

Our policy (applies to all customers):​​

  • After the 14-day cooling-off period has passed, no refunds will be issued for cancellations.

  • Non-attendance is considered as a cancellation, and no refund will be given.

  • In exceptional circumstances, and at the discretion of the Director, course credit may be offered for future use. Requests must be made in writing and will be considered on a case-by-case basis.

  • Digital products (downloads/online content): non-refundable once accessed/downloaded, except where legally required.

Our changes/cancellations:
If we must change dates, trainer, venue, or format, we’ll notify you promptly. If we cancel, you can choose a new date or a full refund of fees paid. We are not liable for travel, accommodation, or other indirect costs. We aim to use fair variation terms consistent with consumer-law guidance for education providers. 

6) Attendance, conduct & certification

6.1 Attendance – You must attend all required hours and complete practical/assessment elements.
6.2 Professional conduct – We reserve the right to remove any learner whose conduct is unsafe, disruptive, discriminatory, or breaches professional standards; refunds will not be due in such cases.
6.3 Assessment & safety – Trainers may withhold certification where minimum competence, professional behaviour, or safety standards are not met.
6.4 Certificates – Issued to learners who complete all criteria. Certificates reflect attendance and competence at assessment; they are not a guarantee of outcomes in your practice.

7) Health, accessibility & adjustments

7.1 Health – Practical courses involve hands-on work. Inform us of any health or access needs in advance; you’re responsible for your own wellbeing during participation.
7.2 Adjustments – We’ll make reasonable adjustments where safe and feasible; where an adjustment is not possible, we’ll discuss alternatives.
7.3 Insurance & scope – You are responsible for ensuring your insurance and local scope of practice cover any techniques you use after training.

8) Venues, equipment & safety

We select appropriate venues and provide equipment needed for training. Follow all health & safety instructions. You are liable for damage caused by negligence or misuse.

9) Intellectual property & recording

Course manuals, slides, videos, and associated materials are protected by copyright. No recording (audio/video) of training is permitted without our written consent. You must not copy, share, publish, or resell our materials.

10) Reviews, testimonials & user content

If you submit reviews or testimonials, you grant us a non-exclusive licence to display them (edited for length/clarity only, without changing meaning). Do not post unlawful, defamatory, or misleading content.

11) Liability

11.1 Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
11.2 For Consumers: we will provide services with reasonable care and skill. If we do not, you may be entitled to repeat performance or a price reduction under the Consumer Rights Act 2015.
11.3 For Business Customers: our total liability for all claims arising from a course or sale is limited to the price paid for that course/sale. We are not liable for loss of profits, business interruption, or indirect/consequential losses.

12) Privacy, cookies & data

Your data is handled as described in our Privacy Policy (linked in the footer). By booking you acknowledge our privacy and cookie practices. (Wix provides hosting and some processing services.)

13) Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., extreme weather, power/network outages, illness, government restrictions). If such events affect a course, we will rearrange where possible or refund fees paid for undelivered services.

14) Changes to services or Terms

We may update these Terms or our services periodically. The version published on our website at the time you book applies to that booking. For ongoing services, we’ll give reasonable notice of material changes.

15) Complaints

Please raise any concerns with your trainer or email info@lymphaeumeducation.com. We aim to respond within 7 working days and resolve issues promptly and fairly.

16) Governing law

These Terms are governed by the laws of England and Wales. Courts of England and Wales have non-exclusive jurisdiction. Consumers may also bring claims in their local UK court.

17) Consumer information summary (distance bookings)

  • Cooling-off rights: generally 14 days for services unless an exemption applies; charges may apply for services started within the period. Certain date-specific leisure services are exempt from cooling-off. #

  • Refunds (where due) are made via the original payment method within 14 days of agreement/eligibility.

What to include in the T&C document

Generally speaking, T&C often address these types of issues: Who is allowed to use the website; the possible payment methods; a declaration that the website owner may change his or her offering in the future; the types of warranties the website owner gives his or her customers; a reference to issues of intellectual property or copyrights, where relevant; the website owner’s right to suspend or cancel a member’s account; and much, much more.
